Terms of Service

These Terms of Service govern your use of Papigochi, the event-services marketplace operated by Papigochi, LLC at papigochi.com.

By creating an account, sending an inquiry, publishing a vendor storefront, or making or receiving a payment through Papigochi, you agree to these Terms.

Our Privacy Policy, Refund & Cancellation Policy and Vendor Terms are part of this agreement. If you operate as a vendor, the Vendor Terms apply to you in addition to these Terms.

Papigochi is a marketplace and a set of tools. We help customers discover event vendors, ask them questions, compare what they offer, agree terms, book and pay.

The event services themselves — the music, the photography, the catering, the venue, the transport and everything else listed on Papigochi — are provided by independent vendors, not by Papigochi. Each vendor is a separate business responsible for its own work.

This distinction matters, so it is stated plainly:

• Papigochi is not the performer, caterer, photographer, venue or any other service provider, and does not employ them.
• The agreement to perform an event service is between the customer and the vendor. Papigochi is not a party to it.
• Papigochi does not guarantee any vendor’s quality, availability, punctuality, conduct or the outcome of any event.

Papigochi does provide the marketplace itself: the storefronts, the messaging, the booking tools, the payment processing and the support channel — and we are responsible for those.

To use Papigochi you must:

• Be at least 18 years old and able to enter into a binding agreement.
• Give accurate account information and keep it current.
• Use the account type that reflects how you actually use Papigochi.
• Not be barred from using the service under applicable law, and not be using it on behalf of someone who has been suspended.

You are responsible for your account and for anything done through it. Keep your password private and do not let anyone else use your account.

Tell us promptly at the support address below if you believe someone has accessed your account without your permission.

Account type is set when you sign up. A vendor account is created for vendors and cannot be converted by the account holder; if you chose the wrong type, contact support.

When you use Papigochi to find and book a vendor, you agree to:

• Describe your event honestly, including date, location, guest count and anything a vendor needs to quote accurately.
• Communicate with vendors respectfully and respond in reasonable time once a request is in progress.
• Read the vendor’s proposal, package and any contract before accepting it — those describe what you are actually buying.
• Pay the amounts you have agreed, on the terms agreed.
• Understand that the vendor, not Papigochi, performs the service, and raise problems with the vendor first where that is possible.

Vendors have additional obligations, set out in full in the Vendor Terms. In summary, a vendor agrees to:

These obligations exist because customers make real plans and real payments based on what a vendor publishes.

• Publish truthful listings, pricing and availability, and keep them current.
• Perform the services booked, at the time and place agreed.
• Respond to customers and honour the terms of any proposal or contract sent.
• Complete Stripe Connect onboarding before accepting payments through Papigochi, and maintain a valid subscription where one is required for the features used.
• Hold and maintain any licence, permit or insurance the service legally requires.

Nothing in these Terms makes a vendor an employee, agent or partner of Papigochi. Each vendor is an independent business.

A vendor storefront is content published by that vendor. Papigochi may review, verify, edit the presentation of, decline to publish, or remove a listing — but we do not independently confirm every claim a vendor makes.

“Verified” on Papigochi means the Papigochi team has reviewed the vendor’s account against our internal checks at a point in time. It is not a warranty of quality, licensing, insurance or performance.

If you believe a listing is inaccurate, misleading or infringes your rights, tell us at the support address below.

Vendors set their own prices. Papigochi supports two ways of buying, and which one applies is shown on the vendor’s page:

• Quote-based services — you send a request, the vendor replies with a proposal, and a price exists only once you accept it.
• Directly bookable services — the vendor has published a price and real availability, and you can book a specific time yourself.
• Published prices, packages and availability may change at any time until a proposal is accepted or a booking is confirmed.
• Prices are shown in the vendor’s currency. Papigochi does not convert currencies.

Payments for bookings processed through Papigochi are currently taken in US dollars. Where a booking cannot be processed through Papigochi, the customer and vendor may still arrange payment directly, and Papigochi is not involved in that payment.

An inquiry is a request to a vendor. Sending one is not a booking, does not hold a date, and does not commit either side.

A vendor may decline an inquiry, or not reply at all. Papigochi does not guarantee that any vendor will respond, quote or accept your event.

Withdrawing an inquiry ends the request; a vendor declining it does the same. Either way the conversation record is kept.

A proposal is the vendor’s offer: a description, line items and a total. It may have an expiry date, and a vendor may withdraw or replace it before it is accepted.

Accepting a proposal creates an agreement between you and that vendor on the terms it sets out. Where a contract document is generated and signed on Papigochi, that document — including any cancellation or payment terms the vendor has included — governs the job.

Papigochi provides the tools that produce and store these documents. Papigochi is not a party to them and does not give legal advice about them. Read a proposal or contract before you accept or sign it.

A booking is created when a customer books a directly bookable service, or when a quote-based agreement reaches the point of a confirmed date.

A booking moves through states you can both see: requested, confirmed, rescheduled, cancelled or completed. Papigochi records each change and who made it.

• A request is not a confirmation. A date is held only once the booking is confirmed.
• Reschedules must be agreed between the customer and the vendor; Papigochi records the request and the outcome.
• Either side may cancel, subject to the vendor’s terms and to the Refund & Cancellation Policy.

Papigochi may cancel or refuse a booking where we believe it breaches these Terms, involves fraud, or cannot be completed safely.

Payments made through Papigochi are processed by Stripe. You enter your card details on a payment page hosted by Stripe; Papigochi does not receive or store your card number.

How a booking is paid depends on what the vendor requested:

• A deposit may be requested against a signed contract, and a final balance may be requested afterwards.
• Each payment is charged in full at the time you make it. A deposit is not a hold or an authorisation.
• Payment is confirmed by Stripe, not by the page you land on afterwards. If a payment is still processing, the booking will say so.
• Funds for a booking are settled to the vendor’s Stripe account, with the Papigochi fee taken at the same time.
• You are responsible for any taxes on the services you buy or sell, unless the law requires Papigochi to collect them.

Customers pay no Papigochi service fee. The price you agree with the vendor is the price you pay through Papigochi.

Papigochi earns from vendors, not from customers.

Two fees exist, both payable by the vendor:

• A vendor subscription, billed monthly in the vendor’s market currency, which unlocks the vendor tools. It renews until cancelled.
• A per-booking platform fee, calculated from the agreed booking total and capped per booking. It is disclosed to the vendor and is not added to the customer’s price.
• Papigochi does not process bookings above a maximum value; above it, Papigochi does not take the payment at all.

Fee rates and caps may change. Changes take effect prospectively and never re-price a booking that has already been agreed.

Payment processing on Papigochi is provided by Stripe. By making a payment you also accept Stripe’s applicable terms.

Vendors who receive money through Papigochi must complete Stripe Connect onboarding and accept the Stripe Connected Account Agreement directly with Stripe. Stripe decides whether an account may accept charges and receive payouts, and Papigochi cannot override that decision.

If Stripe restricts or disables a vendor’s account, that vendor cannot be paid through Papigochi until Stripe resolves it.

Cancellations and refunds are governed by the Refund & Cancellation Policy, which forms part of these Terms, together with any cancellation terms in the vendor’s own proposal or contract.

Papigochi does not promise that every payment is refundable, and does not declare that all sales are final. What applies depends on the vendor’s terms and the circumstances — the Refund & Cancellation Policy explains how that is decided.

Papigochi carries messages between customers and vendors, and keeps a record of them. When you use it:

• Keep the conversation about the event. Do not send abusive, harassing, deceptive or unlawful messages.
• Understand that Papigochi retains the conversation and may review it to investigate a report, a payment problem or a dispute.
• Do not send payment credentials, government identification numbers or other sensitive personal data through Papigochi messages.

Reviews help other customers choose. To keep them useful:

• Write about your own genuine experience with the vendor.
• Do not post fake, paid, incentivised or retaliatory reviews, and do not review your own business or a competitor’s.
• Do not include other people’s personal information, or content that is unlawful, hateful or harassing.
• Papigochi may decline to publish, or may remove, a review that breaches these rules. We do not remove a review simply because a vendor dislikes it.

You keep ownership of what you publish on Papigochi — your listing text, photos, videos, links, messages and reviews.

By publishing it you give Papigochi, LLC a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for display, and show that content in order to operate and promote the marketplace and your presence on it. This licence lasts while the content is on Papigochi and for a reasonable period afterwards in backups and records.

• You confirm you have the rights to everything you upload, including photographs of other people’s work or likeness.
• You must not upload content that infringes copyright, trademark, privacy or publicity rights.
• Where you link a YouTube video, that video is delivered by YouTube under its own terms, and you are responsible for having the right to associate it with your business.
• Papigochi may remove content that breaches these Terms or the law.

If you believe content on Papigochi infringes your rights, write to the support address below with enough detail for us to identify it.

You must not use Papigochi to:

• Impersonate another person or business, or misrepresent your affiliation with one.
• Publish false, misleading or deceptive listings, prices or availability.
• Harass, threaten, defame or discriminate against anyone.
• Commit fraud, launder money, or use stolen payment credentials.
• Offer or request anything unlawful, or any service Papigochi has told you it does not permit.
• Manipulate reviews, ratings, verification or search results.
• Collect other users’ personal information, scrape the site, or use automated tools against it without our written permission.
• Attempt to breach, probe or circumvent the security of Papigochi or any account.
• Interfere with the operation of the service, or overload it deliberately.
• Use Papigochi to send unsolicited advertising or spam to other users.

Papigochi may review accounts, listings, messages, bookings and payments where necessary to keep the marketplace trustworthy — for example when investigating a report of fraud, a payment problem or a safety concern.

We may verify a vendor, request additional information, limit features, decline to process a payment, or hold a payout while a matter is being investigated.

We are not obliged to monitor everything published on Papigochi, and reviewing some content does not make us responsible for all of it.

You may stop using Papigochi at any time and ask us to close your account.

We may suspend or terminate an account, remove content, or withdraw access to features where we reasonably believe there has been a breach of these Terms or the law, a risk of fraud or harm, or where Stripe or another provider requires it.

Where it is practical and lawful to do so, we will tell you why. Suspension does not cancel obligations already incurred: a booking already agreed, a payment already owed and a refund already due all survive.

Papigochi, its name, logo, design, software and the arrangement of the site are owned by Papigochi, LLC or its licensors and are protected by intellectual property law.

You may use the site as intended. You may not copy, modify, distribute, sell, reverse engineer or create derivative works from Papigochi, or use our name or branding without written permission.

Papigochi relies on third parties — including Stripe for payments, and services that deliver embedded videos and email. Their terms and policies apply to their part of the experience.

Links to third-party sites are provided for convenience. We do not control them and are not responsible for their content or practices.

Papigochi is provided on an “as is” and “as available” basis. We work to keep it accurate and running, but we do not warrant that it will be uninterrupted, error-free, or that any listing, price or availability shown is correct at every moment.

We make no warranty about any vendor, any customer, or the performance of any event service arranged through Papigochi. We do not guarantee that a vendor will be available, will perform as described, or that an event will succeed.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow certain disclaimers, in which case they apply to you only to the extent permitted.

To the fullest extent permitted by law, Papigochi, LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or losses arising from a vendor’s or a customer’s acts or omissions.

Papigochi does not accept liability for the performance of an event service. Claims about the service itself lie between the customer and the vendor.

Nothing in these Terms excludes liability that cannot lawfully be excluded. The specific monetary limits that apply to any remaining liability are still being finalised and will be published in a future version of these Terms.

If something goes wrong with an event service, raise it with the vendor first — most problems are resolved there.

If it cannot be resolved, or if it concerns a payment, a refund, safety or a breach of these Terms, write to support@papigochi.com with the booking details and what happened. We will look into it and tell you what we can and cannot do.

The governing law, the venue for any legal proceeding, and any agreement to arbitrate have not yet been settled for Papigochi and are therefore not stated here. They will be added in a future version of these Terms, and you will be told before that change takes effect.

We may update these Terms as Papigochi changes. The effective date at the top of this page always shows the version in force.

Where a change is material we will make reasonable efforts to tell you in advance. Continuing to use Papigochi after a change takes effect means you accept the updated Terms.
